General Terms and Conditions of Sale and Use (CGV)

ARTICLE 1 - Champ d'application

These General Conditions of Sale apply, without restriction or reservation, to all sales concluded by Afghani Oil (“the Seller”) to consumers and non-professional buyers (“The Customers”), wishing to acquire the products offered for sale by the Seller (“The Products”) on the website www.afghanioileu.com. They specify in particular the conditions of ordering, payment, delivery and management of possible returns of Products ordered by Customers. These General Conditions of Sale may be supplemented by special conditions, set out on the website, before any transaction with the Customer. They are accessible at any time on the website www.afghanioileu.com and will prevail, where applicable, over any other version or any other contradictory document. These General Conditions of Sale may be subject to subsequent modifications, the version applicable to the Customer's purchase is that in force on the website on the date the order is placed. Modifications to these General Conditions of Sale are binding on users of the website www.afghanioileu.com from the time they are put online and cannot apply to transactions previously concluded.

ARTICLE 2 - Products offered for sale

The Products offered for sale on the www.afghanioileu.com website are as follows:

• Afghani oil hair oil: nourishes and strengthens hair, promotes hair growth and improves hair texture.

The main characteristics of the Products, in particular specifications, illustrations and indications, are presented on the website www.afghanioileu.com. Before placing an order, the Customer is required to refer to the description of each Product in order to know its essential properties and particularities. The choice and purchase of a Product are the sole responsibility of the Customer. The photographs and graphics presented on the www.afghanioileu.com website are non-contractual.

The contractual information is presented in French and is subject to confirmation at the latest when the order is validated by the Customer. The Products presented on the www.afghanioileu.com website are offered for sale for international delivery.

ARTICLE 3 - Validity period of the Product offer

Product offers are within the limits of available stocks, as specified when placing the order.

ARTICLE 5 - Price

The prices of the Products are indicated in euros on the website www.afghanioileu.com. They are also displayed in other currencies for the convenience of the Customer. Delivery costs are indicated when placing the order and are the responsibility of the Customer, unless otherwise indicated.

The Seller reserves the right to modify its prices at any time, while guaranteeing the Customer the application of the price in force at the time of validation of the order.

ARTICLE 6 - Orders

The Customer has the possibility of placing his order online, from the online catalog and using the form which appears there, for any Product, within the limits of available stocks.

The Customer must create a customer account on the website www.afghanioileu.com to place an order. He must fill out a form with his personal information necessary for billing and delivery.

For the order to be validated, the Customer must accept, by clicking where indicated, these General Conditions of Sale. He will also have to choose the address and the delivery method, and finally validate the payment method.

The sale will be considered final:

• after sending the Customer confirmation of acceptance of the order by the Seller by email;
• and after receipt by the Seller of the entire price.

The Seller recommends that the Customer keep a copy of the data relating to his order on paper or computer.

The Customer can follow the progress of his order on the website www.afghanioileu.com.

ARTICLE 7 - Payment terms

The price is due immediately on the date of the order. Payments will be made online by credit card. They will be carried out through the secure system which uses the SSL (Secure Socket Layer) protocol, so that the information transmitted is encrypted by software and no third party can become aware of it during transport on the network.

The Customer's account will be debited for the total amount of the order at the time of validation of the order.

ARTICLE 8 - Deliveries

The Products ordered by the Customer will be delivered in mainland France and internationally to the address indicated by the Customer when ordering on the website. www.afghanioileu.com.

The Seller undertakes to deliver the Products within the deadlines indicated when placing the order. These deadlines are given for information purposes only and any reasonable delay in the delivery of the Products cannot give rise to the cancellation of the order or the payment of damages.

Delivery is made by an independent carrier, to the address indicated by the Customer when ordering and to which the carrier can easily access. In the event of the Customer's absence, a delivery notice will be left at the delivery address indicated by the Customer, inviting the latter to collect the Products ordered according to the terms specified by the carrier.

The risks associated with transport are borne by the Customer from the moment the Products leave the Seller's premises. In the event of damage during transport, a reasoned protest must be made to the carrier within three days of delivery.

ARTICLE 9 - Right of withdrawal

The customer has a period of fourteen days from receipt of the Products to exercise his right of withdrawal from the Seller, without having to provide reasons or pay a penalty, for the purpose of exchange or refund, provided that the Products are returned in their original packaging and in perfect condition within fourteen days following notification to the Seller of the Customer's decision to withdraw.

Returns must be made in their original condition and complete (packaging, accessories, instructions). In this context, the Customer's responsibility is engaged. Any damage suffered by the Product on this occasion may be such as to frustrate the right of withdrawal.

Return costs are the responsibility of the Customer. If the right of withdrawal is exercised, the Seller will reimburse the sums paid, within fourteen days following notification of the withdrawal request, and via the same means of payment as that used when ordering.

ARTICLE 10 - Guarantees

All Products supplied by the Seller benefit from the legal guarantee provided for by articles 1641 et seq. of the Civil Code. In the event of non-conformity of a Product sold, it may be returned to the Seller who will take it back, exchange it or reimburse it. All complaints, requests for exchange or refund must be made by post to the following address: Maison Zenia, Compass Building, Al Shohada Road, AL Hamra Industrial Zone-FZ, Ras Al Khaimah, United Arab Emirates, in a period of thirty days after delivery.

The Products supplied by the Seller also benefit, in addition to the legal guarantee of conformity, from the commercial guarantee. Details of the commercial guarantee are available on the website www.afghanioileu.com.

ARTICLE 11 - Liability

The Seller's liability cannot be incurred in the event of non-performance or poor performance of the contract due either to the Customer's actions, or to the insurmountable and unforeseeable act of a third party to the contract, or to a case of force majeure.

ARTICLE 12 - Personal data

The information collected by the Seller during any order from the Customer is necessary for the management of the transaction and for this purpose may be communicated in whole or in part to the Seller's service providers involved in the execution of the order. The Customer is informed that these same personal data may also be collected by an organization responsible for analyzing orders and combating bank card fraud.

ARTICLE 13 - Intellectual property

The content of the www.afghanioileu.com website is the property of the Seller and its partners and is protected by international laws relating to intellectual property. Any total or partial reproduction of this content is strictly prohibited and may constitute an offense of counterfeiting.

 

ARTICLE 15 - Disputes

All disputes to which the purchase and sale operations concluded in application of these General Conditions of Sale could give rise, concerning their validity, their interpretation, their execution, their termination, their consequences and their consequences and which could not have been be resolved between the Seller and the Customer will be submitted to the competent courts under the conditions of common law.
